Inquests create serious risk to Registered Providers as they have become far more high profile in recent years given the focus on building safety and customer engagement. These proceedings need handling carefully, usually at a senior level with legal support given the risk of negative press coverage, subsequent litigation and regulatory engagement. Failing to be prepared or seek appropriate support is a significant risk and one that we see materialise often.
Boards need to scrutinise if their organisation is prepared to deal with inquiries from the Coroner, the process and all that flows from this, and if not assured, ask what is being done should such a situation arise.
In this session we will cover:
- The legal requirements for Corporate Manslaughter
- Examples of prosecutions
- Personal liability under the Health & Safety At Work Act and the Building Safety Act
