Managing and defending Employment Tribunal claims

Overview

Facing an Employment Tribunal claim can place significant pressure on an organisation, particularly where the issues are sensitive, complex or carry reputational risk. Our experienced Employment team provides clear, practical advice to help employers manage and defend claims, with a focus on achieving outcomes that reflect their commercial priorities and wider organisational objectives.

We have extensive experience defending employers in Employment Tribunal proceedings, from straightforward unfair dismissal claims to complex disputes involving whistleblowing, discrimination, harassment, victimisation and equal pay. We also advise on civil claims, including breach of contract, and pursue appeals and defend employers in the Employment Appeal Tribunal.

Our approach to litigation is strategic and measured. We take the time to understand your organisation, the circumstances surrounding the dispute and the pressures you face. We identify the issues that matter, assess settlement and reputational risks, and work closely with you to determine the most appropriate way forward. Where settlement is appropriate, we consider opportunities to resolve disputes while protecting your organisation's interests.

We understand the particular challenges facing employers in highly regulated sectors, including social housing, health and social care, local government and the charity sector. Our knowledge of these environments allows us to provide advice that takes account of operational, governance and regulatory pressures alongside the legal issues.

Beyond defending claims, we help employers address workplace issues that can lead to disputes, including misconduct, grievances, disciplinary procedures and whistleblowing concerns. We also advise on internal investigations and provide training for HR teams, managers and senior leaders.
