Building safety before the Court of Appeal

The Court of Appeal recently handed down its highly anticipated judgment in URS Corporation Limited v BDW Trading Limited (2023), which deals with two separate but related appeals.

The dispute between the parties concerned building safety defects in a number of high-rise buildings across England and the litigation has been ongoing since 2021. The subject matter is highly topical.

The discovery of defects in one building led the respondent, BDW Trading Limited (BDW), to undertake a wholesale review of a number of other blocks it had developed in connection with which members of the AECOM group had been engaged to provide structural engineering designs for their construction.
