Not the end of the story

The 2021 judgment on preliminary issues and the recent Court of Appeal decision consider some important points of law. The Court of Appeal dismissed both the appeal in respect of the judge’s order on the preliminary issues and the amendments appeal against the orders made by the deputy judge.

BDW has therefore been allowed to amend its claim.

We now look forward to the next instalment which will consider BDW’s claim under the DPA and Contribution Act.
